Discusses the scope of judicial review and human rights with regard to market traders' public law rights, with particular attention to the definition of "public function" in terms of judicial review and a "function of a public nature" under the Human Rights Act 1998 s.6(3)(b). Considers factors such as: (1) how markets are distinguished under the law; (2) common law regulation of lawful markets; and (3) public law regulation and markets.
