Abstract
To what extent do copyright contracts depend on the existence of statutory copyright law? Can contracts even replace copyright statutes? It is argued that statutory copyright matters, but differently than often assumed. In the second part of the article, the effects of copyright contracts on authors’ earnings are reviewed, drawing on two recent empirical studies in Germany and the UK.
